Terms of service

The short version

  • Evnie helps your business show up accurately in AI answers. AI tools are run by other companies, so we can't guarantee what they say.
  • You own your business information. By adding it to Evnie, you let us use and share it, including with AI platforms and partners, to provide the service.
  • Paid plans are monthly. Cancel any time; it stops at the end of your billing period.

1. These terms

These terms are an agreement between you and FINTechNC, which operates Evnie ("Evnie", "we", "us"). By using the Evnie website, the free report card, or the Evnie service, you agree to them and to our privacy policy. If you use Evnie for a business, you confirm you're authorized to act for that business and accept these terms on its behalf. You must be at least 18.

2. The service

  • Free report card: we ask AI assistants a customer-style question about your type of business and city, and show what they said.
  • Paid plans: a verified business profile, monitoring of AI answers, a chat assistant for your website, online booking, and related features, as described on our pricing page.
  • Early access: joining the early-access list is free and doesn't commit you to buy anything.

We may add, change or remove features over time.

3. No guarantees about AI answers

AI assistants are owned and run by other companies. Their answers change from one question to the next and are outside our control. Report card results are a snapshot, not a ranking or a promise. We don't guarantee that any AI tool will mention, recommend or describe your business in any particular way, or that your business will gain customers.

4. Your information and the license you give us

You keep ownership of the business information you give us. You're responsible for making sure it's accurate, current, and yours to share.

To provide Evnie, you give us a worldwide, non-exclusive, royalty-free license to collect, store, use, copy, format, display, and share your business information, and to license it to AI platforms, data partners and other third parties, for the purpose of operating, providing, promoting and improving Evnie. This license continues while your information is in Evnie. If you opt out of sharing or delete your information, we'll stop sharing it going forward, but partners may keep copies they already received.

We may also use information combined across many businesses, in a form that doesn't identify you, to improve Evnie and create insights and products.

5. Acceptable use

You agree not to:

  • add false or misleading information, or information about a business you don't represent;
  • use the free report card in an automated way, or to overload or get around our limits;
  • scrape, copy or resell Evnie or its data without our written permission;
  • try to break, probe or reverse-engineer Evnie's systems;
  • use Evnie for anything unlawful, deceptive or harmful.

We may remove information, limit access, or close accounts that break these rules.

6. Fees and billing

  • Prices are shown on our pricing page and are in US dollars, before any applicable taxes.
  • Paid plans are billed monthly in advance and renew automatically until you cancel.
  • We'll give you at least 30 days' notice by email before changing the price of your plan.
  • Cancellation and refunds work as described in our refund policy.

7. Third-party services

Evnie connects to services run by other companies, including AI assistants and hosting, email and payment providers. Their own terms apply to their services, and we aren't responsible for them.

8. Our property

Evnie's software, design, name and logo belong to FINTechNC. These terms don't give you any rights to them beyond using Evnie as intended.

9. Disclaimers

Evnie is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don't promise the service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent the law allows, Evnie and FINTechNC won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers or data. Our total liability for any claim relating to Evnie is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

11. Indemnity

You agree to defend and hold harmless Evnie and FINTechNC from claims arising from information you provide, your use of Evnie, or your breach of these terms.

12. Ending the agreement

You can stop using Evnie and cancel any time. We may suspend or end your access if you break these terms or if we stop offering the service; if we stop offering a paid service, we'll refund any time you've paid for but not used.

13. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in North Carolina, unless the law where you live requires otherwise.

14. Changes

We may update these terms. If a change is significant, we'll tell account holders by email at least 30 days before it takes effect. Continuing to use Evnie after that means you accept the new terms.
